Terms of Service

1. Agreement to terms

By creating an account or using Bolsivo ("Service," "Platform"), you agree to these Terms of Service ("Terms"). If you are using Bolsivo on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use the Service.

2. Description of service

Bolsivo is a B2B software platform that helps service business owners:

• Search for potential business clients using publicly available data sources (Google Places API; Yelp Fusion API integration coming soon)
• Score and qualify those prospects using AI
• Generate personalized outreach email drafts
• Manage email approvals, follow-ups, and a sales pipeline
• Create service estimates and professional proposals (Scale plan)

3. Acceptable use

You agree to use Bolsivo only for lawful B2B outreach to commercial entities. You must not:

• Use the platform to contact individuals (B2C) without proper consent mechanisms
• Send unsolicited bulk email ("spam") in violation of CAN-SPAM, CASL, or applicable law
• Impersonate another person or business in email communications
• Use false or misleading subject lines or sender information
• Bypass the approval workflow to send emails automatically without review
• Attempt to circumvent rate limits, plan limits, or suppression lists
• Scrape, resell, or redistribute lead data obtained through the platform
• Use the platform for any purpose that violates applicable law

CAN-SPAM compliance obligation

You are responsible for ensuring all emails sent through Bolsivo comply with the CAN-SPAM Act and any other applicable email laws. Bolsivo enforces technical safeguards (suppression lists, unsubscribe links, postal address inclusion, send limits), but legal responsibility for your outreach remains with you.

4. Plans, billing, and payments

4.1 Subscription plans

Bolsivo offers tiered subscription plans (Free, Starter, Pro, Scale) with different feature sets and usage limits. Plan details and pricing are described on our pricing page. We reserve the right to modify pricing with 30 days' notice to active paid subscribers.

4.2 Payment

Paid subscriptions are billed monthly in advance via Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis. All payments are in US dollars.

4.3 Cancellation and refunds

You may cancel your subscription at any time through the Billing page (Stripe Customer Portal). Cancellation takes effect at the end of the current billing period. We do not provide partial refunds for unused time, except where required by law.

If you are not satisfied with Bolsivo for any reason within the first 30 days of your first paid subscription, email us at support@bolsivo.com and we will issue a full refund — no questions asked and no conditions required. This guarantee applies once per customer account on the first paid term only.

4.4 Plan limits

Each plan includes monthly limits on leads and daily limits on email sends. Exceeding these limits will restrict the relevant feature until the next billing cycle. Limits are per organization, not per user.

5. Data and intellectual property

5.1 Your content

You retain ownership of content you create in Bolsivo (campaign configurations, email copy, notes, pricing profiles). You grant Bolsivo a limited license to process this content to provide the Service.

5.2 Third-party data

Lead data sourced from Google Places API is subject to Google's Terms of Service. You may not store this data beyond the purposes permitted by those terms.

5.3 Platform

Bolsivo and all associated software, designs, and trademarks are owned by Bolsivo. You may not copy, modify, distribute, or create derivative works based on the platform.

6. Disclaimers and limitation of liability

6.1 No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that lead data is accurate, complete, or current. Google Places data reflects publicly available information and may contain errors. Lead scores are AI-generated estimates and do not guarantee sales outcomes.

6.2 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOLSIVO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

7. Termination

We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. Upon termination, your access to the Service ends. We will retain your data for 90 days before deletion, during which you may request an export.

8. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes will be resolved in the courts of Delaware, and you consent to personal jurisdiction in those courts.

9. Changes to terms

We may update these Terms from time to time. We will notify active subscribers of material changes by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
